You NEVER assign anything without a term limit (good enough for the President, good enough for me).

I recommend to my patent clients (where, not having as much lobbying money, we are limited to 20 years), to not assign, but sign an exclusive license (say for 10 years, with following 5 year options). Sure, you'll take less money up front, but insurance ALWAYS costs money.

Of course you Copyright/TM people with your effective eternity (75, 99, 125, who can count that many years?) should REALLY pay attention to insurance and 'corporate' prenups.

Keep them coming Jean, if a certain PR government agency does not get educated in patent infringement, maybe we can have some more postings for this blog!

A lowly (but happy ;-) patent prosecutor,

Reiterates Registration as Prerequisite for Moral Rights Claim

Saludos Jean.

Nelson E. Facebook

In this case facebook should be more concerned with their losing their own name.
Advice for FB lawyers drop the lawsuit and stop trying to bully the domain name social networking market. Most of these startup site are kids or cant afford to fight so thy just cave to "Cease and desist".

Live trademarks that existed before facebook.

myyearbook (FIRST USE IN COMMERCE: 20040101 G & S: social networking services)
yellowbook (FIRST USE IN COMMERCE: 19961211 G & S: ONLINE CLASSIFIED)
myblackbook (FIRST USE IN COMMERCE: 20041001)
SCRAPBOOK OF MEMORIES (FIRST USE IN COMMERCE: 20040128 G & S: Scrapbooks)

Then why didn't thy registor the name book?
BOOK (Filing Date October 7, 2010 G & S: creating an on-line community)

source http://www.uspto.gov/trademark...
There are over 9691 trademarks with the term "book" .
The uspto thought that lamebook, placebook and many others should exits and thy allowed them even with facebooks protest. Why hummm IDK could it be because thy know facebook wasn't the first. If thy are claiming that the use of "book" dilutes facebook, well i think thy lost that right years ago. Book is nothing without the term face. If thy want to stop someone from using facebooksucks.com now that I can see....

Re: Recent Trademark Infringement Filing: Total Petroleum v.
